It is common for
major incidents or problems arising on construction and engineering
projects to generate both insurance claims and contractual claims.
Some of our clients
have recognised that the skills and expertise we bring to bear in handling
their insurance claims can also be utilised to assist them with
contractual claims.
There have been
instances where our involvement has made the contracted parties
aware that the potential exists for an insurance claim under a
project policy in respect of incidents which were initially dealt
with as a contractual dispute.
In such cases,
the parties involved have agreed to set aside their dispute in order to jointly
pursue a claim under the policy for losses and costs sustained,
instead of sharing the financial burden themselves.
